Between individuals, no law requires the borrower to justify how the money is used, yet a loan with no documents at all does not exist in practice: ID, written proof above 1,500 € and form 2062 above 5,000 € remain necessary for protection.
Two meanings of no supporting documents
The phrase means either a loan with no proof of use, where the borrower spends the money freely, or a loan with no paperwork whatsoever. The first is common and legal; the second is mostly a sales pitch used by fake lenders.
What the Consumer Code imposes on banks
Credit institutions must check the borrower's creditworthiness before any consumer credit, and a purpose-linked loan requires proof of the purchase financed. A private person who lends occasionally is not bound by these professional obligations under French consumer law.
The free-use personal loan between individuals
Like a personal loan between individuals, a loan without proof of use lets the borrower spend the money on a bill, a trip or a rental deposit. The contract can still mention the purpose, which clarifies the relationship if a dispute arises.
Documents an honest lender will still request
A serious lender will want at least an identity document, bank details and sometimes proof of income to assess repayment capacity. These requests are legitimate as long as they stop there and come with no advance payment of any kind.
Written proof still required above 1,500 €
Even with no proof of use, article 1359 of the Civil Code demands written evidence for a loan above 1,500 €. The IOU records the amount, date, instalments and full identity of both signatories, with one copy kept by each party.
Tax reporting on formulaire 2062
Per impots.gouv and Service Public, a loan between individuals above 5,000 € must be declared on formulaire 2062 (French tax form for declaring loans), attached to the income return. This formality does not require justifying the use, only the loan and party details.
When no documents hides a data harvest
Paradoxically, the advert promises a loan without paperwork, then the fake lender demands passport, tax notice, selfie and bank details. These are used to open accounts or credit in the victim's name, as our page on identity theft and private loans explains.
Processing fees demanded after approval
Once approval is announced, the fraudster invents an obstacle: registration fees, compulsory insurance or a bank release charge, payable in vouchers or cryptocurrency. A legitimate lender may deduct fees from the capital, never in advance outside the banking system.
Crowdlending platforms and identity checks
Platforms licensed by the AMF, the French financial markets regulator, as crowdfunding service providers carry out identity and anti-money-laundering checks. An offer calling itself a platform yet asking for no documents is suspicious; check its licence on the official registers.
Reading the contract carefully before signing
A careless contract copied from a foreign template may contain unfair clauses or a rate above the usury ceiling set by the Banque de France. Our guide to checking a private loan contract lists the clauses that must appear.
Funds of dubious origin and anti-money laundering
Receiving a large sum from a stranger without any formality can turn the borrower into a laundering relay, known as a money mule. Banks report unusual transactions to Tracfin, and the account holder may face criminal proceedings.
Advice and remedies when in doubt
Before sending any document, seek advice from a consumer association, a point-justice legal advice centre or a notary. In case of attempted fraud, report the advert on PHAROS or Signal Conso and warn your bank immediately.
Borrowing without proof of use while staying protected
- Choose an identifiable lender, ideally met in person, and refuse any anonymous offer spread through a messaging app or social network.
- Limit documents sent to ID, bank details and possibly proof of income, masking unnecessary data with a watermark.
- Draft a contract or IOU specifying amount, term, any interest rate and the repayment timetable.
- Receive the money by transfer from a bank account in the lender's name, without paying any upfront fee.
- Attach form 2062 to your income return if the loan exceeds 5,000 €.
- Repay by identifiable transfers and keep the statements until the final receipt.
Costs and financial risks of a no-paperwork loan
| Item | Rule or amount | Key point |
|---|---|---|
| Interest rate | Free, below the usury rate | The usury rate is published every quarter |
| Processing fees between individuals | Normally none | Any advance outside a bank is suspicious |
| Licensed platform commission | Varies by platform (indicative) | Shown before any signature |
| Tax on interest | Investment income | Declared by the lender |
| Identity theft after sending documents | Sometimes heavy losses | Quick account block and complaint |
The minimum to prepare anyway
- Valid identity card or passport
- Bank details in the borrower's name
- Proof of income if the lender asks
- Signed loan contract or IOU
- Form 2062 above 5,000 €
- Repayment schedule and proof of transfers
Loan scam signals to recognise
- An advert reading loan without documents, answer within an hour, posted on Facebook or Leboncoin by a new profile with no verifiable history.
- A request for a selfie holding your ID, a tax notice and bank codes, although the offer promised no documents.
- Registration or insurance fees payable by prepaid card, Bitcoin or money transfer before the loan is paid out.
- A contract written in clumsy French, bearing a fake notary or lawyer stamp and an address abroad.
- A proposal to receive money and then pass part of it to a third party, the typical money mule pattern.
Common questions on loans without supporting documents
Can an individual lend to me without my justifying how the money is used?
Yes. Between individuals, the borrower has no legal duty to say what the money is for. The lender may still ask and write it into the contract. Only purpose-linked credit from professionals requires proof of the purchase financed.
Is it normal for a private lender to ask for my ID?
It is in fact essential for drafting a valid IOU. The lender should also show you theirs. The request becomes suspicious when it extends to bank codes or a selfie with the document, or when it precedes a demand for fees.
Does a loan without documents escape tax reporting?
No. Reporting on form 2062 depends on the amount, not on the papers supplied: it applies above 5,000 €. Forgetting it can lead to a tax fine. The tax section of the site and the local tax office explain the procedure.
I sent my documents to a fake lender: what now?
Alert your bank, block your card or account if banking details were shared, and watch your statements. File a complaint for attempted fraud and report the profile on PHAROS. Keep all messages: they will help if credit is opened fraudulently in your name.
